Terms & Conditions

The following provisions are designed to protect the customer and Japan Holidays.

DEPOSITS

A non-refundable initial part payment of $200 per person is payable within 48 hours of
confirmation. Some activities/products have their own strict deposit regulations, which you will be made aware of at the time of booking. Failure to pay the deposit may result in your travel arrangements being cancelled.

PAYMENTS
Full payment is due 30 days prior to departure. Bookings made within 30 days of intended
travel are to be paid in full immediately upon confirmation. Certain special air fares may
require payment immediately upon booking. In the event that Japan Holidays agrees to
the acceptance of Credit Card payments, they will be made available through special
arrangement with the Travel Agent and Japan Holidays reserves the right to charge a fee to
the Credit Card Holder for this service.
If for any reason the initial part payment or the final balance is not received by Japan Holidays on the due date, Japan Holidays reserves the right to treat your booking as cancelled and apply appropriate cancellation charges. The deposit will be forfeited.

CANCELLATION
Cancellations are subject to a charge to cover estimated costs:
(a) Up to 30 days prior to departure AUD$120 per person;
(b) Within 30 days of departure 75% of Total costs per person, plus any charges levied by hoteliers and/or land operators.
In certain circumstances cancellation fees may be subject to GST and will therefore be charged to the client.

AIR
A cancellation of Airline bookings incurs the same charges as above cancellation fees plus
any charges as required by the Airline Tariff Regulations.

BOOKING FEES
Non refundabale deposit of $200 pperson
Accommodation only booking - $35.00 per booking
Late booking - within 7 days of departure - $60.00 per booking
After confirmation, amendment or re-booking fees of AUD$35 per amendment will apply. In
addition airlines or other service providers may also charge a fee.

DOCUMENTATION & PROCESSING FEES
Amendments - $35.00 per booking
Itemised quotes (refunded upon booking with us) - $100 per quote
Itinerary planning (refunded upon booking with us) - $100 per booking

REFUNDS
To the extent permitted by law, no refund is available after the tour has commenced in
respect of any tours, accommodation, meals or any services not utilised. Product and service providers are unable to authorize any refund on Japan Holidays’ behalf.

TRAVEL INSURANCE
Japan Holidays strongly recommends that you purchase a comprehensive travel insurance
policy at the time of booking. Your Travel Agent will be able to advise and assist you with this.

BAGGAGE
All baggage and personal effects are at all times at your own risk. Any excess baggage
charges are the responsibility of the passenger.

PRICING
All rates on this web site are expressed in Australian dollars and are current at the time of
printing - 31st May 2008. Japan Holidays reserves the right to amend without notice the prices on this website for any reason including but not limited to amendments due to currency fluctuations, the withdrawal of contracted rates with land and service providers, airfares, fuel, airport and airlines taxes and surcharges, Australian or Japanese Government charges and web site uploading errors. All possible care has been taken in the compilation of this web site Current valid prices will be advised on request and confirmation by way of invoice to you or your Travel Agent when your booking is made. Pricing will be guaranteed only after Japan Holidays has received total payment.
If Japan Holidays is forced to change your booking or part of your booking for any reason
beyond its control, it reserves the right to vary your itinerary and will give you notice thereof,
including any change in price. In the event that any one change or series of changes to
your itinerary demonstrates that your tour has thereby become materially different from the
tour contemplated prior to the changes being effected and in respect of which, we have
accepted your deposit or full payment, you have the right to ask for a rearrangement or to
withdraw from the tour and all monies will be refunded less any charges levied by suppliers. It is essential you check with your Travel Agent as to whether any such changes have occurred in your tour before you complete your final payment. If in the unlikely event that Japan Holidays has to cancel your tour because of events outside its control, Japan Holidays will, if it is able to, offer you an alternative tour of similar standard. If you do not accept this alternative tour, Japan Holidays will refund in full any monies already paid.

NOT INCLUDED IN THIS TOUR PRICE
Interstate and intrastate passengers are responsible for the cost of their own travel
arrangements from their home town to and from their choice of the international departure
city. The costs of any accommodation in Australia, passport/s, and visa costs where
applicable, are not included in the tour price, nor are items of a personal nature.

does not take responsibility for failure of any individual product/services to provide accurate
information or for the photographs supplied by the product/service providers, for use on this
web site.

BOOKING ARRANGEMENTS
All booking arrangements must be made through Japan Holidays or your local AFTA Travel
Agent. The person effecting the booking shall be deemed to have accepted the booking
conditions on behalf of all persons named in the booking. The contract will be governed by
and subject to the booking conditions and to the general information unless stated otherwise
in writing and with the authority of Japan Holidays. All communication will be sent to your
Travel Agent. Your agent upon receipt of any tour monies shall hold such monies for each and every person named in the booking until the booking is confirmed, at which time those monies shall be paid to Japan Holidays within 48 hours as a part payment.

DOCUMENTATION
A valid passport is required by travellers to Japan. Those not travelling on an Australian Passport may require a Visa. This is the traveller’s responsibility. Air tickets and travel vouchers will be issued after full payment has been received by Japan Holidays. Documents will be forwarded to the Travel Agent by standard mail. If Express Post or a Courier is required, a fee, recoverable from you, will be charged at Japan Holidays discretion.

LIABILITIES
The Trade Practices Act implies a warranty that the services rendered by Japan Holidays will rendered with due care and skill and nothing contained in these conditions is to be construed as in any way excluding, restricting or limiting that warranty or any other rights implied by law which may not be excluded, restricted or modified.

Japan Holidays and its associated companies and their employees are not liable for:
a). any event beyond their control, including (but not limited to) war, disturbances, fire, flood,
unusually severe weather, act of God, act of government or other authorities, accident
or failure of machinery or equipment, or industrial action ( whether or not including Japan
Holidays employees); nor
b). any act or omission whatsoever (whether within or outside its control) in relation to any
booking, contract, travel, accommodation, excursion or other holiday services (including
the carriage of baggage) which results in any direct, indirect or consequential loss, damage,
death, injury, delay, liability, additional expenses or inconvenience. Japan Holidays does not
own or operate any tour product or service listed in this brochure. Japan Holidays is a tour
wholesaler which arranges the provision of the products & services listed. Japan Holidays
does not take responsibility for the omission or failure of individual properties, plant or services detailed on this web site.

AIRLINE DISCLAIMER
The airlines do not by virtue of their endorsement of this brochure, represent themselves either as contracting with any purchaser of a holiday from Japan Holidays or as having any other legal relationship with any other purchaser detailed on this web site.

LAW OF CONTRACT
The State of Queensland shall govern any contract arising with the client and any legal action arising there from shall be litigated only in the appropriate court having jurisdiction in that state.
